Any changes to this agreement or added obligations assumed by either party in connection with this agreement shall be binding only if in writing with prior consent from both parties. Should the owner/owners of the property described herein fail to make any payments as agreed and promised to A Plus Exterior LLC, we, the company, reserve the right to undertake any forms of collections deemed necessary to recover the monies owed. This includes applying interest at a rate of 1.5% per month (18% annually) and incurring any and all legal fees required for this process. Additionally, failure to make payment within thirty (30) days of completion will result in the forfeiture of any and all discounts previously offered. In such an event, A Plus Exterior LLC also reserves the right to place a lien on the property at the owner’s expense.

START DATE: ROOFING AND SIDING WITHIN 2-4 WEEKS OF SIGNATURE EXECUTION DATE

  1. Retainage: I hereby affirm and agree that the maximum amount of money I may withhold from any payment due and owing to A Plus Exterior LLC shall not exceed five percent (5%) of the underlying amount attributable to work performed by A Plus Exterior LLC. For example, if a final payment of $10,000 is due, I will remit to A Plus Exterior LLC no less than $9,500 and withhold no more than $500. All sums withheld pursuant to this Withholding Agreement shall be remitted to A Plus Exterior LLC upon completion of any ‘punch out’ items identified within thirty (30) days after the substantial completion of A Plus Exterior LLC’s work. Please visit your customer portal or our website and fill out our punch list form to ensure that no items are missed.
  2. Change orders: Any and all changes to agreement require a change order signed by both parties. It is agreed and understood that A Plus Exterior LLC shall not be obligated to make any repairs until said change order and payment has been received. The rate for any such additional work shall be established as $75.00 per man hour plus the cost of materials, unless otherwise specified in writing. A Plus Exterior LLC abides by all building codes and strictly follow manufacturer Installation instructions to ensure customer is eligible for manufacturer warranties. By signing agreement you have understood and agreed to waive 3 day cancellation period on change orders.
  3. SCHEDULING OF PROJECT(S): The specific start date for each trade involved in the project is outlined below. Please note that A Plus Exterior LLC cannot be held accountable for any delays arising from external factors. These include, but are not limited to, unforeseen delays caused by third-party contractors, adverse weather conditions, challenges in sourcing necessary materials, or restrictions in property access due to homeowner availability. We endeavor to adhere to the scheduled timelines, but these external factors are beyond our control and may impact project timelines.
  4. Clean Up: At A Plus Exterior LLC, we take great pride in our commitment to maintaining cleanliness throughout our projects. We will diligently clean up all debris and use a magnetic roller across your yard to collect any stray nails. However, given the scale and complexity of major construction projects, there may occasionally be a few nails or minor debris that escape our notice. Additionally, such extensive work may result in slight scratches to gutters, some disturbance to your yard and landscaping, or residual debris in the attic. While we strive to minimize these impacts, we request your understanding and cooperation in these matters. For your safety and peace of mind, we recommend a cautious approach during the first few weeks after the project’s completion, particularly in monitoring for any stray nails. Your safety is paramount to us, and we truly appreciate your collaboration in ensuring a secure and satisfactory project outcome.
  5. Dumpster: A Plus will not be responsible for damages caused by the dumpsters delivered onto the property as needed to complete the contracted work or damages caused by others while delivering material. Suppliers carry liability insurance for such instances please notify your sales rep if any issues arise.
  6. Construction Vibration: A Plus will not be responsible for any ceiling, wall or other damages to the customers home due to normal vibrations during the installation of this work. The customer is responsible for the removal of any and all wall hangings, nick knacks, etc. that may be disturbed or broken during the installation of this project.
  7. TV/Phone: A Plus Exterior LLC is not responsible for lack of tv reception after install customer must call local service provided. More common with Satellite service providers and roofing installations.
  8. Payments: We accept all major credit cards, ACH transfers, and offer flexible payment options. By choosing to pay with a credit card, you authorize us to charge the card provided for the amount agreed upon. Please be assured that we will not charge your credit card without prior consent. A 50% deposit is required to order materials and schedule or start the project (unless specified otherwise above). The final payment is due upon project completion, assuming there are no outstanding punch list items. If there are punch list items, 45% of the payment is due, with the remaining 5% payable upon completion of these items. Please refer to line item 2 above for details on the retainage agreement. For projects involving multiple trades, final payments are due upon the completion of each specific project.
  9. Permits: A Plus Exterior LLC will obtain all necessary permits, the association/customer is responsible for all payments. To enable A Plus Exterior LLC to pull a building permit, all property and vehicle taxes associated with the project location must be current. Projects involving multiple trades or aspects are handled separately unless otherwise noted in the agreement.
  10. Access: We will need your driveway cleared the day of the build in order to park our trailer or dumpster, which will be used to haul away the existing shingles and debris. Keep all children and pets inside, or away from the house. There will be a significant amount of noise and debris. We take care to protect your landscaping and will place a perimeter around your home.
  11. Power: We will tear the entire roof down to the wood, inspect for rotten or warped wood, and bring to your attention any additional issues before installing new underlayment as depicted in material section above, shingles, and the ventilation system. On occasion, we may need to use your exterior power to cut sheets or plywood. If you have any concerns or would not like us to do so, please discuss this with your sales representative so that it can be appropriately noted in our contract.
  12. Landscaping: A Plus Exterior LLC shall not be liable for damage to landscaping as a result of gaining access to the job site, and/or covering shrubbery to work in a neat manner. It is the Owner(s) responsibility to water before/after the A Plus Exterior LLC removes the tarp to prevent Shrub burns.
  13. Mold: A Plus Exterior LLC is not responsible for indoor air quality including growth of mold. The Owner shall hold harmless indemnify A Plus Exterior LLC from claims, including claims of tenants and occupants, due to indoor air quality in resulting from a failure by Owner to maintain the interior of the building and adequate ventilation in a manner to avoid growth of mold.
  14. Installation Methods: Should the customer decide against addressing issues that impact A Plus Exterior LLC’s capability to adhere to the recommended manufacturer’s installation guidelines, it will result in an immediate annulment of all warranties. Under these circumstances, it is mandatory for a waiver to be executed prior to the commencement of the installation process. Additionally, A Plus Exterior LLC will issue a formal written notification regarding this decision.
  15. Limited Warranty: A Plus Exterior LLC commits to guaranteeing all work for the duration specified by the product manufacturer’s warranty for the chosen installation materials. Additionally, A Plus Exterior LLC assures a 100% workmanship guarantee on our labor for installation, valid for a lifetime. In the event of any issue, the homeowner is obliged to promptly contact A Plus Exterior LLC. We provide a warranty for the roof against winds up to 130 mph. Should wind damage occur within this specification, resulting in shingle loss, A Plus Exterior LLC will undertake replacement at no additional cost. Importantly, A Plus Exterior LLC’s warranties are fully transferable without incurring any fees.
  16. Exclusions: The warranty provided by A Plus Exterior LLC does not encompass damages to the roofing system arising from various causes. These include but are not limited to a failing roof structure, a roof system that is improperly designed, and phenomena classified as “acts of God” (such as falling trees, gale-force winds, tornadoes, lightning, etc.), or any other accidents beyond A Plus Exterior LLC’s control.   17. Please be mindful of furniture and personal items around the property. If you request A Plus Exterior to move any items, the company will not be held responsible for any damages that may occur as a result.

Roofing Projects

  1. Start Date for roofing = WITHIN 2 WEEKS OF DEPOSIT RECEIPT OR MATERIAL RECEIPT IF SPECIAL ORDER
  2. General Conditions: A Plus Exterior LLC shall not be held responsible for any debris in the attic resulting from the work outlined in this agreement. Homeowners are required to take necessary measures to protect and cover any items within the attic. If requested, A Plus Exterior can provide tarping services for attic contents at an additional fee of $500.
  3. Equipter: A Plus Exterior utilizes the Equipter RB 4000 on many of its roofing projects. It is a more professional and efficient working process that we have adopted to safeguard your property during installation. Due to the Equipter structure and weight, It is the customers obligation to stake off, warn or make A Plus Exterior LLC aware of places we should not access, tire impressions can occur in your lawn area. A Plus Exterior is not responsible for the impressions or any and all damages made by the Equipter RB 4000, if you request the equipter not be used on your project you must notify A Plus Exterior in writing and it must be written in contract.   4. Unforeseen issues: Any additional work that is unforeseen but is necessary to the soundness of the project in the sole discretion of A Plus Exterior LLC like rotted wood, cracked rafters, etc, will be performed by the homeowner immediately after notification by A Plus Exterior LLC. If the homeowner elects to have A Plus Exterior perform the additional work, a signed written change order must be produced and immediate payment for additional work must be received prior to the commencement of work. It is therefore agreed and understood that A Plus Exterior shall not be obligated to make any repairs until said change order and payment has been received. If there is existing damage on the inside from the preexisting deterioration of the project. A Plus Exterior LLC will not be held responsible. All material is guaranteed to be as specified. All work to be completed in a professional manner according to standard practices.
  5. Gutter systems: We will clean out Gutter system if not being replaced during roofing project. Specialty gutters may hold their own warranty, please be aware some of these warranties are voided If a NON-CERTIFIED company performs work. Please see your gutter warranty information.
  6. Skylight Installation: In the case of skylight installations or replacements, due to changes in skylight sizes and building settling over time, A Plus Exterior LLC cannot guarantee a direct replacement. Therefore, A Plus Exterior LLC will not be held responsible for any interior modifications needed if the new skylight sizes do not fit the existing opening.

Siding Projects

  1. Start Date for Siding = WITHIN 4 WEEKS OF DEPOSIT RECEIPT OR MATERIAL RECEIPT IF SPECIAL ORDER
  2. A Plus Exterior LLC does not employ licensed electricians. As a courtesy, we will reinstall existing lights, but this does not include moving light locations. Please refer to a licensed electrical professional for re-locations. Furthermore, while A Plus Exterior LLC takes all necessary precautions during the installation process, we are not responsible for any potential electrical issues that may arise after the reinstallation of lights. Any potential electrical issues that may arise post-installation should be addressed by a licensed electrician A Plus Exterior is not responsible for nails too close to exterior wall. Building code requires no plumbing or electrical can be installed directly against an exterior wall. Even though unlikely Punctures to pipes or electrical can occur during installation and such issues will be handled at owners expense.
  3. If rotted plywood is present it will be presented to home owner and a change order will follow. Damaged wood rot is common and likely, Home owner agrees and allows up to 200 SF of damaged wood to be replaced at our discretion WITHOUT a change order. Photos will be taken of condition and new wood installed. This allows for a smooth project install without delays caused by waiting for approval .
  4. As hiring Certified Certainteed Installers, (A Plus Exterior LLC) you qualify for extended warranty coverages at an additional cost.
  5. Not responsible for hidden issues behind existing siding that are unforeseen.
  6. Color: If color/siding is special order or specialty siding it can not be returned once ordered, a refund on materials after 3 day cancellation is not possible since supplier has a strict no return policy on such items. Due to our current state material availability are taking longer than usual, please be patient especially for rare specialty items.

Windows and Door Projects

  1. Start Date for windows= WITHIN 2 WEEKS OF MATERIAL RECEIPT WINDOWS MUST BE ORDERED
  2. Window orders are final and no refund will be issued after 3 day cancellation period. Windows are made custom to fit and manufacturers have a strict no return policy unless received damaged or defected. A Plus Exterior does not manufacture the windows therefore we are not responsible for delays caused by manufacturer delays beyond our control. Please allow up to 8 weeks for delivery.
  3. Start date on windows is subject to lead time of materials chosen. A Plus Exterior LLC will start project no later than 2 weeks after receipt of materials.
  4. A Plus Exterior LLC is not responsible for damages to paint or trim unless specified in contract. Depending on installation method required and age and type of siding A Plus Exterior will not be responsible for damages to siding unless specified in writing

Gutter Installs

  1. Start Date for Gutters= WITHIN 2 WEEKS OF DEPOSIT RECEIPT OR MATERIAL RECEIPT IF SPECIAL ORDER
  2. A Plus Exterior LLC is not responsible for clogged gutters unless leaf protection is installed please refer to leaf protection chosen warranty for information.
  3. Lifetime warranty on workmanship or issues caused during installation.
  4. Not responsible for acts of god beyond our control like tree, lightning, ice dams etc.

  6. A plus exterior is not responsible for gutter straps which require installation under roof shingles. Worn roof shingle can crack when lifted, we will do our best to not damage shingles.

Safety

All of our crews have OSHA Safety training and have been properly trained in safety procedures to keep our employees safe. If you see one of our employees not following safety procedures please notify us. We carry $1,000,000 General Liability Insurance and we agree to keep policy active during duration of project.
